These Terms of Service (“Terms”) form a binding agreement between you (“Customer”, “you”) and Fyder (“Fyder”, “we”, “us”) for use of Fyder OS and related products, websites, APIs, and support services (collectively, the “Services”).

2. Accounts and eligibility
You must provide accurate account information and keep credentials secure. You are responsible for activity under your account.

3. License and acceptable use
Subject to these Terms and your subscription plan, Fyder grants you a limited, non-exclusive, non-transferable right to access and use the Services for your internal business purposes.

4. Customer content
You retain ownership of content you upload or generate through the Services (“Customer Content”). You grant Fyder a limited license to host, process, transmit, and display Customer Content solely to provide and improve the Services.

5. Fees, term, and termination
Paid plans are billed according to your selected subscription and the Billing & Subscription Policy. Trials convert to paid plans unless cancelled before the trial ends, where applicable.
Either party may terminate for material breach if not cured within a reasonable period after notice. Upon termination, your access ends and we may delete Customer Content after any applicable retention window, except where law requires retention.

6. Disclaimers and limitation of liability
Except as expressly stated, the Services are provided “as is” without warranties of uninterrupted or error-free operation.
To the maximum extent permitted by law, Fyder’s aggregate liability arising out of these Terms is limited to the fees paid by you to Fyder for the Services in the twelve (12) months before the claim. Fyder is not liable for indirect, incidental, special, consequential, or lost-profit damages.

7. Governing law
These Terms are governed by the laws of India, without regard to conflict-of-law principles, unless a written order form states otherwise. Courts in Pune, Maharashtra shall have exclusive jurisdiction, subject to mandatory consumer protections that cannot be waived.
